Below the Belt Decision

In one of the more important decisions written by Bush-appointed judge Brett Kavanaugh, the D.C. Circuit today held that an employee of the House of Representatives who jokingly grabbed his, ahem, crotch while talking to several female employees could be demoted without running afoul of employment discrimination laws, notwithstanding the employee’s claim that he was really demoted because of his race.  The crotch grabbing incident was a legitimate, non-discriminatory reason for his demotion.  I guess Major League Baseball will have to seek an exemption from federal anti-discrimination laws as well.
