Robert Van Tuinen, a student at Modesto Junior College, was told by a campus police officer that he couldn’t pass out Constitutions on Tuesday, which was Constitution Day. The officer told Tuinen that he need permission before passing out materials on campus, and then directed Tuinen to the student-development office where he could fill out forms to be granted permission.
Tuinen asked the officer at one point, “Isn’t that a violation of my First Amendment rights.” The cop responded, “I don’t think so.”
When Tuinen made it to the office, he was told that he could only pass out the Constitutions in a designated “free speech zone” after requesting permission in advance.
