Coffin: Question Now Is Whether Hillary ‘Willfully’ Broke Law by Not Signing Separation Form

Former Department of Justice attorney and contributing editor to National Review contributing editor Shannen Coffin reacted to the State Department’s claim that it has no record of Hillary Clinton signing a “separation” form requiring her – under penalty of perjury — to turn over government e-mails, saying the question is now whether the former Secretary of State “willfully” broke the law by failing to sign.

“There’s evidence that would at least raise questions about whether she’s committed a crime,” he told Fox News’s Megyn Kelly on Tuesday. “That crime depends upon state of mind, which is willfulness. And willfulness requires that you know that what you’re doing is wrong, and you know that it’s a crime as well.”

Coffin pointed out that in 2012, Clinton fired the U.S. ambassador to Kenya for “doing something very similar — setting up a private e-mail system in an embassy.”

“The Federal Records Act says that the obligation of the department is actually the obligation of the secretary,” Coffin continued. “The Federal Records Act says that the secretary is responsible for preserving all of the records of the agency. It falls on the Secretary of State to be the responsible party.”

“So the Federal Records Act is very clear that Hillary Clinton is the one who bore responsibility under the law,” he concluded.
