Dennis Henigan hopes that will happen. By taking confiscation and bans off the table, he writes, Heller will make softer gun controls seem less dangerous to gun owners. If supporters of gun rights put all their eggs in the Supreme Court’s basket, Heller could indeed set back their cause. But I think Henigan is succumbing to wishful thinking. If his scenario were to play out at all, it would only be after many years. Gun owners would have to see that new liberal appointments to the Court did not cause a reversal, etc.
