Orin Kerr blogs about the Supreme Court’s decision in the Kansas case here (the comments are interesting, too). Justice Scalia’s concurrence debunks some myths about the supposed exoneration of more than 100 innocent death-row inmates–something I’ve written about in the past. (I’ve turned against the death penalty since writing the linked article, but I still find my fellow abolitionists’ misrepresentation of our national record on execution appalling.)
