Democratic Pa. Attorney General Won’t Defend State’s Gay-Marriage Ban

Once again, an elected Democrat state official is refusing to defend in courts a state law that prevents the state from recognizing gay marriages, reports the Philadelphia Daily News: 

Multiple sources confirmed that [attorney general Kathleen] Kane, who is named along with Gov. Corbett as a defendant in the suit, plans to make the announcement at the National Constitution Center.

The American Civil Liberties Union filed the lawsuit, known asWhitewood v. Corbett, on Tuesday on behalf of 21 state residents. The plaintiffs are 10 couples and one widow who want to marry here, want the state to recognize their out-of-state marriages or want equal protections granted to straight married couples


Kane isn’t the only one who’s refused to defend such a law. Then-attorney general Jerry Brown in California also refused to defend California’s anti-gay-marriage measure, Proposition 8. When the Supreme Court addressed the case, they ruled last month that the non-state officials who had been defending Proposition 8 didn’t have legal standing to do so.
