‘Democrats seek financial rescue of minority-owned broadcasters’

So says a headline in The Hill today. Bailouts are bad enough without adding unconstitutional racial discrimination to the mix. And the Supreme Court would likely agree. The Court upheld the use of racial preferences by the Federal Communications Commission in 1990, but overturned that decision in 1995. Also, among the 1990 dissenters was Justice Kennedy (and Justice O’Connor, by the way).
