. . . regarding a case the Supreme Court recently announced it would hear, in which the constitutionality of Section 5 of the Voting Rights Act is challenged. My only quibble is that Will characterizes as “another facet of the Voting Rights Act” a problem that is, in fact, part and parcel of the Section 5 provision that is being challenged. Another provision, Section 2, may be what Will had in mind, namely, the use of the act to require racially gerrymandered and segregated voting districts. Such segregation turns the ideals of the original act on its head. Its cessation would be a key benefit of Section 5’s demise; conversely, its continuation would be a key cost if the Court allows the act to stand.
