This latest Newsweek column seems heavier on rhetoric than analysis. Which may be good, since the analysis is uncharacteristically weak. “The [Geneva] conventions are not exactly optional. They are the law of the land, signed by the president and ratified by Congress.” Fine, but who disputes the point? When Rumsfeld says that the conventions don’t “apply” to some prisoners, he is not saying that he doesn’t recognize the conventions’ authority; he is expressing a judgment about the interpretation of them. Zakaria seems to know that. So what’s the point of the law-of-the-land scolding?
