Drudge, the LA Times and the Washington Post have made a great deal of hay in the last day or two about Viet Dinh and Michael Chertoff raising objections or concerns about Jose Padilla and/or Gitmo. Drudge’s headline was “Patriot Act author has concerns….” That’s all cool. But it is worth noting that the detainees at Gitmo have absolutely nothing to do with the Patriot Act and neither does the whole “enemy combatants” issue. Indeed, many at the Justice Department have always wanted to go after the enemy combatants themselves. In other words, this isn’t an example of the Patriot Act overreaching, it’s an instance where justice might be served if the Patriot Act’s reach extended even further.
