… actually relates to a serious situation — in Iraq. The man in question obviously has habeas rights because he’s a citizen and Congress hasn’t moved to strip citizens of habeas rights, but the courts are (thankfully) ruling that they do not have jurisdiction in the case. It may be an American-run prison that he’s held in, but neither international law nor the related bilateral agreements give U.S. courts a basis to take jurisdiction away from Iraqi courts in domestic (Iraqi) criminal cases. This is an interesting case from the Amnesty International point of view, because if the courts ruled otherwise, they would be requiring the military to violate Iraqi sovereignty, something Amnesty generally objects to — except of course when it suits them.
