A few of us were having a discussion concerning the Supreme Court’s decision on eminent domain. During this discussion the following question was posed: “Is there any Constitutional protection against a local government forcefully taking a kidney by eminent domain from one citizen and giving it to another citizen assuming the first citizen is given fair market value for the kidney and the greater good of the local community benefits from the transfer?
