In August, the Obama administration sued Louisiana over its school-voucher program, which was designed to help low- and middle-income children in failing schools attend private institutions, claiming that the program impeded the desegregation process.
However, it seems that Eric Holder and the Justice Department can’t produce the documents at the center of their lawsuit.
The DOJ filed a new court motion Tuesday in which they requested extra time to respond to the court’s request for documents, including the desegregation orders fundamental to the Obama administration’s lawsuit. The DOJ reportedly needs time to request the documents from archives and evaluate them (one wonders how the DOJ could have filed the lawsuit without looking at the necessary documents in the first place).
Governor Jindal responded to news of this request for delay:
The Obama Administration’s lawsuit against Louisiana’s scholarship program is a case study on incompetence. The administration’s latest gaffe is an admission that it sued the state based on documents the Department of Justice is not able to readily produce. To reiterate, the Department of Justice does not even have the very documents that are allegedly the foundation of its lawsuit. This is the latest example of incompetence from the Obama Administration.
In their request for a delay, the DOJ argued that, beyond not being immediately accessible, the documents were not necessary for the upcoming hearing.
