Judge Posner’s Goofiness

Greenhouse quotes Judge Richard Posner (“one of my favorite judges”). Which reminds me that Posner recently got attention for saying, “I’ve become less conservative since the Republican Party started becoming goofy.” About which, two reactions:

1) Why is a sitting judge commenting on partisan politics?

2) This is a guy who clearly believed, against the vast majority of the public, that partial-birth abortion should be legal — and whose argument for it strongly implied that infanticide should be legal as well. (Some detail on this lowlight of Posner’s career appears in this editorial; my book has more.) There are worse things than being thought goofy by such a man.
