Ed Meese and the other conservatives at the Justice Department concluded that the line-item veto was unconstitutional.  Ronald Reagan reluctantly concluded the same.  But when President Bush introduced his own form of the line-item veto, which he believed addressed the Court’s objections, many supported it (not me).  This, I believe, is what Mitt Romney is defending.  Moreover, Rudy’s use of the courts to sue the gun manufacturers and for the commuter tax remains indefensible.  As I recall, he failed in those efforts.
