Maybe Not So Useless

An encouraging — though probably doomed — development: “Mr.

Derbyshire—In your latest article, you mention that Article III, Section 2

of the Constitution gives the Congress power to make Regulations and

Exceptions with respect to the Supreme Court’s appellate jurisdiction, and

ask, ‘Why don’t they act on it?’ Well, they are. There’s a bill before

the House that would allow the Congress to reverse a Supreme Court decision

on ‘the constitutionality of an Act of Congress.’ It will be interesting to

see what happens to this bill. I suspect it

won’t make it out of committee.”
