Newly Appointed Special Prosecutor ‘Unable’ to Take Jay Jones Reckless Driving Investigation

Just two days after being appointed special prosecutor in the ongoing investigation into Democratic attorney general nominee Jay Jones’s 2022 reckless driving case, James City Commonwealth’s Attorney Nathan Green announced that he is “unable” to take the case.

Green’s withdrawal, first reported by 8News, adds a new twist to the legal investigation into the circumstances surrounding Jones’s completion of 1,000 community service hours as part of his sentencing in the reckless driving case. Green did not explain in his statement why he felt he could not lead the investigation.

New Kent County Commonwealth’s Attorney Scott Renick was originally leading the investigation but recused himself due to an unspecific conflict of interest. New Kent County Circuit County Judge Elliott Bondurant accepted Renick’s recusal request on Tuesday and appointed Green special counsel to take over the probe from Renick, National Review first reported on Wednesday.

“Therefore, in accordance with Section 19.2-155 of the Code of Virginia, as amended, the Court doth appoint Nathan R. Green, Commonwealth’s Attorney for Williamsburg/James City County, or his designee, as Special Prosecutor, to exercise all powers of the Attorney for the Commonwealth in this matter,” Judge Bondurant wrote in an order, which you can read below.

As of this afternoon, it remains unclear who might take over the investigation from Green.
