The Washington Post today reported that the Obama administration has given up on any hope of prosecuting Khalid Sheihk Mohammed in Lower Manhattan. Moreover, there is apparently little appetite in the administration to revive plans to try KSM via military commission, and they may simply allow Mohammed to remain incarcerated at Guantanamo Bay indefinitely, without trial.
