Jon Kyl just put forth the opposition’s strategy if cloture is invoked: death by amendment. So far, proponents of the bill have denied that it is race-based or that civil rights could be abridged or that Hawaiians themselves may not want the bill. But the bill is vague on all points. Kyl and his cohort therefore will offer at least three amendments: The first will say that the entity cannot be based on race or ancestry; the second that the Bill of Rights and all federal anti-discrimination laws will apply; and the third that there must be a statewide referendum after the negotiations on the new government have concluded (recall that the bill only sets the process for forming the government). Needless to say, the bill’s proponents have already told Kyl they are opposed to all three of these amendments. That in itself seems to say it all.
