A reader put me onto this, and CNN just confirmed it. They have Associate Justice Alito shaking his head and mouthing the words “no, that’s not right,” when the president suggested that the Citizens United decision overturned a “century” of law.
We’ll have to check the tape, but very unusual for a Supreme Court Justice to register a reaction at the State of the Union. Unusual, too, for a president to attack the Court’s decisions in the presence of six Justices.
