Respectfully, I don’t applaud the appointment. Sunstein’s book, The Second Bill of Rights, is a rejection of the limits the Constitution places on government, and the judiciary in particular. Perhaps Sunstein has the ability to compartmentalize his radicalism. I certainly hope so. But Sunstein is, at least to some of us, a disaster.

UPDATE: My guess is that just as William Douglas was tapped by FDR to work at the SEC and then for the Supreme Court, a similar course is intended for Sunstein.
