Mark, I think Mickey Kaus is making much too big a deal out of this item. We have no idea what the context is. Maybe someone asked McCain about judges and he said that senators should vote for nominees even if they disagree with their philosophies, as he voted for Ginsburg and Breyer. Maybe he then criticized Senate Democrats for not following this practice. That has been a pretty standard Republican line for the last several years. Now, if it turns out that McCain said that he voted for Ginsburg and Breyer and therefore people should expect him to nominate people like that–well, that would be a problem.
