I would add an amendment of my own to Ramesh’s comment re predicting the kind of judicial candidates McCain would nominate. McCain’s treatment of Jim Haynes, the former general counsel at the Pentagon who helped draft policies related to the treatment of detainees and who was nominated to the federal bench, has been nothing but shabby. His attacks on Bradley Smith, which had much to do with Smith departing the FEC after his term, is also instructive. This needs to be weighed with his votes for Roberts and Alito, and I think the picture is a murky one.
