Ramesh–Tim Lee’s article is spot-on. I can tell you from experience that software patents are on balance a net negative for most small, innovative software companies; that so-called “business method” patents are a joke; and that the bar on obviousness has to be raised substantially. A cynic might be forgiven for arguing that the patent system, at least in this area, now operates primarily for the benefit of the patent bar.
