Ramesh, I just want to make sure I have this right. Romney “is getting a bad rap for wanting to consult with lawyers about what is in large part a legal question” (i.e., the president’s exercise of an executive power) but Giuliani is a judicial activist for citing a Supreme Court ruling on what – in large part, of course — is a question of constitutional law (i.e., the Congress’s assignment of an Article I power to the Article II branch).
