Recess Appointments and the Constitution

The Republican House is blocking a Senate recess by holding pro forma sessions, and thus blocking the president from making recess appointments. Liberals are urging President Obama to make the appointments anyway “to re-establish constitutional order.” But the modern use of the recess appointment power is itself a deformation of the constitutional order.
