I would, of course, vote against the confirmation of Sonia Sotomayor to SCOTUS. Her promotion of shareholder lawsuits, eminent domain, and punitive damages claims would alone sway me. However, I remain hopeful on other fronts. Perhaps, as a preemptionist, she will see fit to knock down the crazy-quilt state and local “employer sanction laws” that succor trial lawyers more than they inconvenience illegal aliens. And perhaps her “empathy” as a Catholic-school graduate will incline her to uphold educational-choice initiatives.
