The Right to be Mediocre

When I saw Stan’s post on “The Right to be Mediocre” as relates to Sotomayor, I just assumed he was conjuring the memory of Sen. Roman Hruska. Since Stan didn’t mention it, I thought I’d repeat his famous defense of Nixon’s Supreme Court pick G. Harrold Carswell:

“Even if he were mediocre, there are a lot of mediocre judges and people and lawyers. They are entitled to a little representation, aren’t they, and a little chance? We can’t have all Brandeises, Frankfurters and Cardozos.”

Update: Just to be clear, I thought Hruska’s comment was laughably stupid. I’m not endorsing it, as a couple readers seemed to think.
