US District Court Judge Loretta Preska, sitting in Manhattan, has dismissed a case brought by Eliot Spitzer et al that sought to impose limits on greenhouse gas emissions by major utility companies by alleging a “public nuisance.” Quite rightly, she said that this was not a matter for the courts, but a policy question for the political branches.
