I don’t think it is an oversimplification to say that Sen. Durbin’s questioning re the coal case amounts to this: How can you have ruled in favor of a coal company against a coal miner, when coal miners are so helpless and sympathetic? Sometimes I think that it is unfair to accuse the Left of believing that judges ought to ignore what the law actually says and just rule in favor of what they think is “fair”; then I realize that it isn’t.
