Senator Durbin’S Opening Statement

Sen. Durbin says that the requirement for any Supreme Court nominee is whether he or she will restrict freedom or expand it. He says a justice should vote to expand freedom even if there is nothing in the Constitution to support such a ruling.

Well, folks, you can’t make it much clearer than that. Conservatives are all for freedom, too (more so on most issues than liberals), but we recognize that the role of judges is to follow the text of the Constitution. The Constitution manifestly does not always restrict freedom and does not always expand it. Sen. Durbin does not believe in a written constitution, but he gets to vote on who sits on the Supreme Court.
