He stressed that the hearings could be “dignified” but still “probing.” This would have been more plausible had it not come so soon after Senator Feinstein had lectured Judge Roberts that the Holocaust apparently resulted from a breach in the wall separating church and state (which, I suppose, judicial conservatives want to tear down).

Also mentioned the 16 cases for which the Senate Democrats want to review Roberts’s memos as deputy Solicitor General. Says that the administration’s refusal to turn over these memos shows that the administration has something to hide. On the weakness of this claim, see earlier NRO column.
