The president is announcing the Kagan nomination as I post. In what seems a preemptive strike, he’s establishing a continuity between Kagan and Justice Stevens’ judicial restraint (?!) and front-ending Kagan’s reputation for recruiting top conservative legal minds to Harvard Law.
