When Evidence No Longer Matters

This, from Jennifer Granholm, is simply remarkable:

Let’s be clear. The witnesses aren’t just saying that they didn’t see Kavanaugh assault Christine Blasey Ford, they haven’t yet offered any proof that Brett Kavanaugh was even at the party. Not even Ford’s friend, Leland Keyser, can substantiate her claims. In fact, as I note in a essay on the home page today, “There is not a single third-party witness to any claim that can corroborate any accuser or even conclusively place Kavanaugh at the location of any alleged crime.”

I’ve litigated a long time, and it is extremely odd for accusers to put forward the names of alleged first-hand witnesses of key events, only to have all of them either contradict or fail to corroborate their story. In any decent court (or even campus tribunal), that failure alone would likely be fatal to an accuser’s claims.

No wonder the Democrats are emphasizing that the Senate isn’t a court. They’re advancing claims that so far can’t possibly meet the lowest standard of proof.
