Wrong Circuit

As a number of readers have pointed out, my posts on the Libby sentencing incorrectly said that the appeal is to the Seventh Circuit.  It will be, of course, to the DC Circuit.  The Seventh Circuit sits in Chicago where appeals from, among other places, the Northern District of Illinois are heard.  The ND of Ill, also in Chicago, is where Pat Fitzgerald is U.S. Attorney.  In an inexplicable case of brain-lock, I allowed myself to forget that the Libby case was brought  in Fitzgerald’s capacity as independent counsel in Washington, not in his day-job as U.S. Atty in Chicago.  The case is in Washington, not Chicago, and the appeal is to the DC Circuit.  Sorry about the confusion.
