UPDATE II: 12:46 p.m.: I just spoke to a source close to the DeLay camp who’s getting live updates from the court. He said the good news is that the judge, Pat Priest, has been pretty tough on Ronnie Earle’s case in his questioning, asking things like, “Why so many indictments?” and “Why are you alleging a violation of criminal law when the transaction is more properly addressed by the election code?” The answer to that last question is that Earle doesn’t have the jurisdiction to prosecute an election code violation against DeLay, so he’s twisting the criminal code to suit his needs. A Professional Letter of Opinion submitted to the court by Professor Susan Klein of the Univ. of Texas School of Law elaborates on this argument (read it here).
